AlignCare - Privacy Policy

1. Introduction

This Privacy Policy explains how Frannaks Healthcare Advisory LLC ("Frannaks Healthcare Advisory LLC," "we," "us," or "our") collects, uses, discloses, retains, and protects information when you use AlignCare, including the AlignCare mobile application and related services (collectively, the "Service" or "App").

AlignCare is a consumer-facing health management app that helps users organize and understand health-related information, including recordings, transcripts, summaries, notes, translations, reminders, sharing features, and AI-powered features such as Nora chat.

We respect your privacy and are committed to protecting the confidentiality, integrity, and security of your personal and health-related information. Some information handled by the App may be considered sensitive personal information, consumer health data, or health-related information under applicable laws.

By using AlignCare, you consent to the practices described in this Privacy Policy. If you do not agree, do not use the Service.

2. Our Role Under HIPAA

AlignCare is a consumer-facing health management app provided directly to users by Frannaks Healthcare Advisory LLC.

AlignCare is not a healthcare provider, health plan, or healthcare clearinghouse, and we are generally not a "covered entity" under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations ("HIPAA"). In most cases, information you enter into AlignCare is not "protected health information" or "PHI" under HIPAA because it is not collected by us on behalf of a HIPAA-covered entity.

Unless Frannaks Healthcare Advisory LLC enters into a separate written Business Associate Agreement with a HIPAA-covered entity or business associate, Frannaks Healthcare Advisory LLC is not acting as a HIPAA business associate.

That said, because the App may process sensitive health-related information, we use safeguards designed to protect your information.

If AlignCare later integrates directly with HIPAA-covered entities in a way that requires us to act as a business associate, we will execute appropriate Business Associate Agreements where required and update applicable documentation accordingly.

3. Information We Collect

We collect information that you provide directly, information generated when you use the App, and information from your device depending on your settings and permissions.

a. Account and Personal Information

We may collect:

  • name;
  • date of birth;
  • email address;
  • account credentials or authentication information;
  • third-party login information from supported sign-in providers, such as Apple or Google;
  • subscription status and purchase confirmation information from Apple App Store or Google Play; and
  • other information you provide when creating or managing your account.

b. Health-Related Information

We may collect health-related information that you choose to provide, record, upload, generate, or store in the App, including:

  • audio recordings of healthcare visits, therapy sessions, appointments, conversations, or other sessions you choose to record;
  • transcripts derived from recordings;
  • AI-generated summaries, notes, structured outputs, suggested questions, or other outputs;
  • translations of recordings, transcripts, summaries, notes, messages, or other content;
  • appointment dates, medication reminders, care instructions, tasks, notes, and related reminders you add;
  • uploaded files, such as lab results, prescriptions, medication lists, visit documents, discharge instructions, insurance documents, or other health-related files;
  • health-related questions, messages, prompts, and responses generated through the App, including Nora chat;
  • provider names, care team information, facility names, clinic or hospital names, specialties, visit dates, symptoms, diagnoses, medications, dosages, treatment instructions, therapy-related information, and other details contained in recordings, transcripts, uploads, notes, chat messages, or summaries; and
  • other health-related information you choose to provide.

c. Recording Other People

If you record a visit, appointment, therapy session, or conversation, the recording may include personal or health-related information about healthcare providers, staff, caregivers, interpreters, family members, or other participants.

You are responsible for obtaining all required permissions and consents before recording, uploading, transcribing, translating, summarizing, storing, or sharing information about any other person. Do not use AlignCare to record or process information where prohibited by law, provider policy, facility policy, or participant preference.

d. Sharing and Recipient Information

When you share content with someone, we collect the information necessary to provide the sharing feature, such as:

  • the private name and relationship label you give that person;
  • which records or record types you shared;
  • the permissions you selected;
  • sharing status and sharing history; and
  • shared content metadata.

We do not collect the phone number of anyone you invite to your Care Circle.

If you shared a visit by email using an earlier version of AlignCare, we retain that recipient's email address and share status so that you can continue to view and revoke those existing shares. Current versions of the App do not create new email shares.

Recipients may copy, save, screenshot, disclose, forward, or re-share information outside AlignCare. We are not responsible for how recipients use or disclose information after you share it.

e. Technical, Device, and Usage Data

We may collect:

  • device type, operating system, browser or app version, and device identifiers;
  • IP address and general geographic region;
  • app usage data, such as features used, screens viewed, buttons tapped, session length, and subscription status;
  • diagnostic, crash, and performance logs;
  • security logs and fraud-prevention signals;
  • push notification tokens, notification preferences, and reminder delivery status; and
  • other technical information used to operate, secure, debug, and improve the Service.

We do not intentionally send recordings, transcripts, notes, uploaded medical documents, translations, or health-related chat content to analytics or crash-reporting providers.

f. Payment Data

Payments are handled by third-party app stores, such as Apple App Store or Google Play. We do not collect or store your credit card number, debit card number, bank account information, or full payment credentials directly.

We may receive store-provided identifiers and purchase confirmation details, such as subscription status, subscription product, renewal status, expiration date, cancellation status, and transaction identifiers.

g. Location Information

AlignCare does not currently collect or use your device's precise location information.

If we introduce location-based reminders in the future, we will request your permission at that time. If you opt in, the App may access your device's precise location solely to enable features such as reminders when you arrive at or leave a clinic, hospital, pharmacy, or other location you choose. You will be able to disable location access at any time through your device settings.

We will not sell precise location information, and we will not use precise location information for advertising or marketing.

h. Biometric Authentication

If you enable device-based biometric login, such as Face ID, Touch ID, Android Biometrics, or similar device authentication, authentication occurs through your device and operating system.

AlignCare does not collect, access, store, or transmit your biometric identifiers. We receive a device or operating-system confirmation indicating whether authentication was successful.

i. Support Communications

If you contact us, we may collect information you provide in support emails, feedback, bug reports, attachments, requests, and related communications.

j. Contacts

AlignCare does not request access to your device's address book. We do not collect, upload, store, or scan your contacts.

k. Information About People You Invite

When you invite someone to your Care Circle, you give us a name and a relationship for that person. These are private labels that help you keep track of your own invitations. Only you see them; the person you invite never does.

We do not ask for or store that person's phone number, and we do not request access to your contacts. We do not contact them — not to deliver the invitation, not to remind them, and not for marketing. You send the invitation yourself, from your own device and messaging account. If they choose to join, they create their own AlignCare account, and the information we then collect is described in "Account and Personal Information" above.

A pending invitation expires after 30 days, and you may delete it at any time.

l. Care Circle Membership and Access Data

If you create a Care Circle or join someone else's, we collect the information needed to operate the feature, including circle ownership and membership, your private labels for the people you invited, invitation status and expiration, what you have shared and with whom, the permissions you chose, and when access was granted, changed, or revoked.

4. How We Use Your Information

We use your information for the following purposes:

  • to provide, operate, maintain, and improve the App's features, including recording, transcription, summaries, notes, translation, reminders, sharing, and Nora chat;
  • to create, manage, authenticate, and secure your account;
  • to process and maintain subscriptions, subscription status, plan access, and purchase confirmations;
  • to generate transcripts, summaries, notes, translations, reminders, AI-powered responses, and other outputs at your direction;
  • to personalize your experience and make features work as intended;
  • to send notifications you enable, including appointment, medication, task, and reminder notifications;
  • to operate Care Circle, including creating and tracking your invitations, applying the access you choose to grant, and notifying you about invitations that are still outstanding;
  • to provide optional security features such as device-based biometric authentication;
  • to respond to support requests, troubleshoot issues, debug errors, and communicate with you about the Service;
  • to protect the security, integrity, and reliability of the Service, including fraud prevention, abuse detection, logging, monitoring, and enforcement;
  • to comply with legal obligations, respond to lawful requests, and enforce our Terms of Service;
  • to protect the rights, safety, and security of users, Frannaks Healthcare Advisory LLC, or the public; and
  • to analyze aggregated or de-identified information to improve reliability, safety, performance, and product functionality, where permitted by law.

If we introduce location-based reminders and you choose to enable them, we may use precise location information solely to provide that functionality.

We do not sell your personal information, health-related information, consumer health data, or precise location information to advertisers or data brokers. We do not share personal or health-related information for targeted advertising.

5. AI Features and Data Use

AlignCare uses artificial intelligence and automated technologies to help provide features such as transcription, visit summaries, notes, translations, suggested questions, and chat-based support through Nora or similar features ("AI Features").

How AI Features Work. The App may process recordings, transcripts, messages, uploaded content, notes, and other information you provide to generate transcripts, summaries, translations, notes, suggested questions, or chat responses.

AI Limitations. AI outputs may be inaccurate, incomplete, outdated, mistranslated, inappropriate, or misleading. AI responses are provided for informational purposes only and are not a substitute for professional medical advice, diagnosis, treatment, or clinical judgment.

Translation Limitations. Translations may be inaccurate or incomplete and should not be relied on for medical decisions without confirmation from a qualified healthcare professional or qualified interpreter.

No Emergencies. Do not rely on AI Features for emergencies. If you think you may have a medical emergency, call 911 or your local emergency number immediately.

No Third-Party Foundation Model Training. We do not use your recordings, transcripts, notes, uploaded documents, translations, or health-related chat content to train third-party foundation models.

Aggregated or De-Identified Information. We may use aggregated or de-identified information to maintain, secure, analyze, and improve the Service, where permitted by law.

6. How We Protect Your Data

We maintain safeguards designed to protect your information, which may include:

  • encryption in transit and at rest for recordings, transcripts, summaries, notes, translations, uploaded documents, and other sensitive data stored by the App;
  • access controls designed to limit system access;
  • administrative monitoring for systems that store or process sensitive data;
  • secure development and operational practices designed to reduce risk and improve resilience;
  • session controls, including automatic logout after periods of inactivity;
  • fraud, abuse, and security monitoring; and
  • device-based biometric authentication performed locally by your device's secure hardware or operating system.

No system, network, device, or transmission method can be guaranteed to be 100% secure. You are responsible for maintaining the confidentiality of your login credentials, protecting your device, using strong account security practices, and controlling access to your email, app store account, and device.

7. Data Retention and Deletion

We retain information for as long as reasonably necessary to provide the Service, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, protect the Service, maintain security, prevent fraud or abuse, and fulfill the purposes described in this Privacy Policy.

Individual Recording Deletion. AlignCare supports deletion of individual recordings. If you delete an individual recording, associated transcripts, summaries, notes, translations, or derived outputs may also be deleted or may require separate deletion depending on the feature and app functionality. Deletion may not immediately remove all copies from backups, logs, or systems where retention is required or permitted by law.

Account Deletion. You may delete your account through the App or by contacting us. Deleting your account permanently removes your recordings, transcripts, AI outputs, summaries, notes, translations, uploaded documents, and profile data from our active systems within 30 days, except where retention is required or permitted by law.

Backups. Backup copies, if any, are securely overwritten or deleted within standard retention windows, generally up to 90 days, unless retention is required by law or necessary for security, fraud prevention, legal compliance, dispute resolution, service integrity, or backup restoration purposes.

Subscription Reminder. Deleting your AlignCare account does not cancel any active subscription purchased through Apple App Store or Google Play. You must cancel subscriptions through the applicable app store provider.

Support and Legal Records. We may retain support communications, transaction records, security logs, consent records, dispute records, and legal or compliance records for longer periods where reasonably necessary or required by law.

Data Export. You may request a copy of certain information associated with your account by contacting us. We may need to verify your identity before fulfilling the request.

8. Data Sharing and Disclosure

We may share information only under the following limited circumstances:

With Your Consent or Direction. We may share information when you choose to share recordings, transcripts, summaries, notes, translations, uploaded documents, or other content with family members, caregivers, providers, or other recipients.

Sharing With Your Care Circle. Being in a Care Circle does not, by itself, give anyone access to your health information. Access is always a separate, explicit choice, and it is always view-only.

You may share specific visits or medications with specific people, choosing what each share includes. You may also give a person ongoing access to a category of records — visits and/or medications, for yourself or for a Shared Profile you manage. If you grant ongoing access that includes future records, records you add later become visible to that person automatically, without asking you again, until you turn the access off.

Ongoing access applies only to the profiles you selected at the time. A Shared Profile you create later is never added automatically.

People you share with can view what you shared. They cannot edit, delete, or re-share your records through the App. You may revoke a share, turn off ongoing access, or remove a member at any time, and their access ends immediately.

Care Circle membership is one-way. Joining someone's Care Circle does not add them to yours and does not give them access to any of your health information.

We act at your direction when you share. We do not verify the identity of anyone who accepts an invitation or joins a Care Circle, and we cannot control what a person does with information once they can see it. Turning off access stops further viewing; it does not retrieve anything already viewed, copied, or saved.

With Service Providers. We use third-party service providers to help operate and support the App, such as hosting and infrastructure providers, authentication providers, app store billing providers, analytics and crash-reporting services, notification services, transcription providers, translation providers, AI providers, and customer support tools. We share information only as necessary for them to provide services in connection with AlignCare and consistent with this Privacy Policy. These providers act as processors, may only use the information to provide services on our behalf under written contract, and may not use it for their own purposes. Service providers may process information in the United States and other jurisdictions where they operate and may use subprocessors.

For Legal Compliance and Safety. We may disclose information to comply with applicable law, lawful requests, subpoenas, court orders, legal process, regulatory obligations, or to protect the rights, safety, security, and integrity of users, Frannaks Healthcare Advisory LLC, the Service, or the public.

For Security and Enforcement. We may disclose information where necessary to investigate, prevent, or address fraud, abuse, security incidents, technical issues, violations of our Terms of Service, or other harmful activity.

In a Corporate Transaction. We may disclose information as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, subject to appropriate confidentiality protections and notice where required by law.

We do not sell personal information, health-related information, consumer health data, or precise location information. We do not share personal or health-related information for targeted advertising purposes.

9. Care Circle Invitations

Care Circle lets you invite family, partners, friends, and caregivers to help you keep track of your health.

You send the invitation. AlignCare creates a private invitation link and opens your device's normal sharing options so that you can send it yourself, through whichever messaging app you use. The message comes from you and from your own account. AlignCare does not send it, and does not send marketing, automated, or promotional messages to anyone you invite.

We do not collect the recipient's phone number. We do not ask for or store it, and we do not request access to your contacts. We never purchase, rent, or append phone numbers.

The invitation contains no health information. The message and its link preview use generic wording such as "Join my Care Circle on AlignCare." They do not name a patient, visit, medication, provider, clinic, or date.

Treat the link as private. The invitation link is not tied to a particular phone number or email address. Anyone who receives it can use it to join your Care Circle until it is used, expires, or you delete it. Send it only to the person you mean to invite, and delete the invitation if it reaches anyone else or you change your mind. We cannot verify who receives or accepts an invitation, and if you attached records to the invitation, whoever accepts it will be able to see them.

Invitations expire, and you stay in control. A pending invitation expires after 30 days, and you may resend or delete it at any time. Because you send the invitation yourself, AlignCare cannot tell whether a message was delivered or read, so an invitation remains pending until the person joins. We may email you — never the recipient — to let you know an invitation is still outstanding.

Joining does not expose the recipient's information. When someone accepts your invitation, they can see only what you chose to share with them. Joining gives you no access to their health information and does not add you to their Care Circle.

10. State Privacy and Consumer Health Data Rights

Depending on where you live, you may have rights under state privacy laws, consumer health data laws, or similar laws. These rights may include the right to:

  • confirm whether we process your personal information or consumer health data;
  • access or obtain a copy of your information;
  • request correction of inaccurate information;
  • request deletion of certain information;
  • withdraw consent for certain processing activities;
  • opt out of certain uses or disclosures, where applicable;
  • appeal a decision regarding a privacy request; and
  • file a complaint with a relevant authority.

Consumer Health Data. Some information collected by AlignCare may be considered consumer health data under certain state laws because it may identify or be reasonably associated with your past, present, or future physical or mental health status, healthcare services, conditions, treatments, medications, visits, providers, care instructions, or related health information.

No Sale of Consumer Health Data. We do not sell consumer health data.

No Targeted Advertising. We do not use consumer health data for targeted advertising.

No Precise Location Advertising. We do not sell precise location information and do not use precise location information for advertising or marketing.

How to Exercise Rights. To submit a privacy rights request, contact us at franklyn@aligncare.ai. We may need to verify your identity before fulfilling your request. Where required by law, you may designate an authorized agent to submit a request on your behalf.

Appeals. If we deny your request and applicable law gives you a right to appeal, you may appeal by replying to our decision email or contacting us at franklyn@aligncare.ai with the subject line "Privacy Appeal."

Limitations. Some rights may be limited by applicable law, technical feasibility, security requirements, legal obligations, or the rights and privacy of others.

11. Your Choices

You may have choices regarding your information, including:

Account Settings. You may update certain account information in the App.

Recording Controls. You choose whether to record, save, delete, or share recordings through available App features.

Individual Deletion. You may delete individual recordings through available App features.

Account Deletion. You may delete your account through the App or by contacting us.

Notifications. You may enable or disable notifications through the App or your device settings.

Location Permissions. If location-based reminders are introduced in the future, you may enable or disable precise location access through your device settings.

Biometric Authentication. You may enable or disable device-based biometric authentication through your device or App settings.

Subscription Management. You must manage and cancel subscriptions through the Apple App Store or Google Play.

Sharing Controls. You choose whether to share content and with whom. Once shared, recipients may copy, save, disclose, forward, or re-share information outside AlignCare.

Care Circle Controls. You choose whether to create a Care Circle, whom to invite, and what — if anything — to share. You may delete a pending invitation, revoke a specific share, turn off ongoing access, or remove a member at any time, and you may leave any Care Circle you have joined. Each of these takes effect immediately.

12. Children's Privacy

AlignCare is not intended for unsupervised use by children under 13. Users under 18 may use AlignCare only with consent and supervision of a parent or legal guardian.

A parent or legal guardian may use AlignCare to manage information about a minor child, subject to this Privacy Policy and our Terms of Service.

We do not knowingly collect personal information directly from children without appropriate authorization. If we learn that a child has used the App without proper consent, we will take steps to delete the account and associated information, subject to applicable law and technical limitations.

Care Circle members must have their own AlignCare account and must be 18 or older. If you manage health information for a minor, use a Shared Profile rather than inviting the minor to a Care Circle.

13. Data Transfers

Your information may be stored and processed in the United States and in other jurisdictions where we or our service providers operate. Data protection laws may differ by location. We take measures designed to protect information and support compliance with applicable requirements.

AlignCare is primarily intended for users located in the United States. If you access the Service from outside the United States, you understand that your information may be processed in the United States or other jurisdictions that may not provide the same level of data protection as your location.

14. Breach Notification Policy

In the unlikely event of a breach involving personal information, health-related information, or consumer health data, we will take steps designed to investigate, mitigate harm, secure systems, and notify affected users and regulators where required by applicable law.

Where applicable, we will provide notices required by state data breach laws, the FTC Health Breach Notification Rule, state consumer health privacy laws, and other applicable privacy or security laws.

15. Updates to This Privacy Policy

We may revise this Privacy Policy from time to time. Updates will be posted in the App, on our website, or by other reasonable means with an updated "Last Updated" date.

If we make material changes, we will provide notice as required by applicable law. Continued use of AlignCare after an update becomes effective constitutes acceptance of the revised Privacy Policy to the extent permitted by law.
